Today, the U.S. Department of Education sent a “Dear Colleague” letter to K-12 schools and institutions of higher education advising educators and administrators that the department’s Office for Civil Rights will enforce the Trump Administration’s 2020 Title IX Rule.
The department will return to enforcing Title IX protections on the basis of biological sex in schools and on campuses.
Returning to the 2020 Title IX Rule also ends a serious threat to campus free speech and ensures much stronger due process protections for students during Title IX proceedings.
“The Biden Administration’s failed attempt to rewrite Title IX was an unlawful abuse of regulatory power and an egregious slight to women and girls.

Now, the U.S. S. The Trump Administration’s 2020 Title IX Rule will be enforced by the Department of Education’s Office for Civil Rights, the department informed K–12 schools and higher education institutions in a “Dear Colleague” letter. This letter follows the successful challenge by Republican Attorneys General to the Biden Administration’s 2024 Title IX rewrite, which was declared illegal and, as a result, unenforceable in all US colleges, universities, and schools by the US District Court for the Eastern District of Kentucky.
The department will resume implementing Title IX protections on campuses and in schools based on biological sex. In addition to ensuring much stronger due process protections for students during Title IX proceedings, returning to the 2020 Title IX Rule also eliminates a significant threat to campus free speech.
“The unsuccessful attempt by the Biden Administration to amend Title IX was a flagrant insult to women and girls and an illegal misuse of regulatory authority. “The Education Department will support equal opportunity for all Americans, including women and girls, under the Trump Administration by defending their right to safety and segregation in schools, colleges, and universities,” stated Acting Assistant Secretary for Civil Rights Craig Trainor.
